After winning a bailiff auction — formalities step by step

You won the auction — and that is only the beginning. Between the highest bid and legally driving the car away sit several formalities: the award (przybicie), paying the balance, transfer of ownership (przysądzenie własności), collection and registration. This guide walks you step by step through the formalities after winning a Polish bailiff auction, so nothing catches you out and you don't lose your deposit.

Step 1. The award (przybicie)

When the highest bid is reached, the bailiff grants the przybicie — formally awarding the item to the winner. At an in-room auction this happens at once; at an e-auction it follows the close of the time window. The award is not yet a transfer of ownership: it confirms that you won the right to buy the vehicle at your offered price.

Step 2. Paying the balance

After the award you have a set deadline to pay the balance — the difference between your bid and the deposit you paid earlier. The deadline and account number are in the notice and in the bailiff's information. This is the critical moment: if you don't pay on time, you lose the deposit and the car goes to another auction.

Step 3. Transfer of ownership (przysądzenie)

Once the full payment clears, ownership transfers to the buyer. For movables the bailiff issues documents confirming the acquisition (a sale record, a decision) that form the basis for registration. This is the moment that makes you the owner — only now can you collect the car.

The final stage is the paperwork at the traffic department (wydział komunikacji) for your place of residence. You will need the documents issued by the bailiff, an ID and proof of payments. Remember compulsory third-party insurance (OC) — it should be valid from the day you became the owner, so arrange it in advance.

The transfer tax (PCC) and any other charges are best confirmed with the tax office (urząd skarbowy), since the details depend on the circumstances of the purchase.
